Lab Games Contest Terms and Conditions

HOW TO ENTER:
To enter the Lab Games Contest (the “Contest”), you must be a fan of either the Life Technologies (http://www.facebook.com/LifeTechnologies), Invitrogen (http://www.facebook.com/invitrogen), Cell Imaging (http://www.facebook.com/cellimaging), Applied Biosystems (http://www.facebook.com/appliedbiosystems) or Novex (http://www.facebook.com/Novexprotein) Facebook page and click on the “Lab Games” link. Just complete the entry form, attach a copy of your photograph and submit. Photographs will be judged on the following criteria:
- 50% on how well the photo meets the criteria of a Lab Game that warrants an athletic trait of speed, agility, extended distance, and high-score;
- 30% in how relative the image is of a Lab Game that could really take place in a lab;
- 20% creativity in utilizing lab equipment, items found in a lab environment, or space in a lab.
Participants can submit as many photographs as they want; however, each individual photograph must be submitted together with an entry form. Photographs that are grossly inappropriate, vulgar, offensive, dangerous or violate rights of the London Olympic Games Organizational Committee (http://www.london2012.com/about-us/our-brand/using-the-brand/) will be eliminated from the Contest. The Lab Games contest is for fun. We are not suggesting that any activities pictured in the photographs submitted for the Contest represent good laboratory practices or that you should engage in any pictured behavior in your own laboratory. Life Technologies takes occupational health and safety practices in laboratories seriously and this Contest is not intended to suggest otherwise.
Only researchers and purchasing personnel working in the life science industry who are 21 years and older, a fan of one of the Facebook pages noted above, and who complete the entry form and submit an appropriate photograph can participate in the Contest. Void in Australia, Belgium, China, Finland, India, Italy, Hong Kong, Sweden, Taiwan and the Canadian province of Quebec. To be eligible to vote on a photograph, participants must be a fan of one of the Facebook pages noted above. The participant with the photograph receiving the highest number of votes will receive $500 (USD) (or foreign currency equivalent). The winner will also have their winning photograph published in the Fall 2012 edition of Life in the Lab and throughout the Life Technologies’ social media pages. Void where prohibited, licensed, or restricted by federal, state, provincial, or local laws, regulations, or agency/institutional policy. Determination of eligibility is at Sponsor’s sole discretion.
FIRST STAGE OF THE CONTEST:
The first stage of the Contest will be held beginning on August 1, 2012 at 12:00 a.m. US Pacific Time and end on August 6, 2012 at 12:00 a.m. US Pacific Time. During this period, participants can enter their photographs in the Contest.
SELECTION OF FINALISTS:
The photographs submitted during the first stage of the contest will be reviewed by a panel of Life Technologies’ employees consisting of two research and development scientists and two members of the Marketing team. The four photographs that best match the above-noted criteria will then be posted on the Facebook pages noted above on August 7, 2012 and fans of those pages can then vote on their favorite photograph.
SECOND STAGE OF THE CONTEST:
The second stage of the Contest will begin on August 7, 2012 and end on August 12, 2012 at 5:00 p.m. US Pacific Time. During this period, fans of the above-noted Facebook pages will be able to vote on their favorite of the four photographs selected by the Life Technologies’ panel. The photograph that receives the highest number of votes will be declared the winner. Voters can vote only once.
The photograph receiving the highest number of votes will be determined on August 12, 2012 and declared the winner (“Winner”). In the event of a tie, the photograph that received the highest number of votes first will be deemed the Winner. The Winner will be notified by email, telephone, or mail approximately 14 days later. If the Winner is unreachable or does not make direct contact with the Sponsor by the date specified in the notification, or fails to accept the prize, the prize will be forfeited in its entirety and the submission that garnered the next highest number of votes will be selected as the winner. The Winner must execute and return an affidavit of eligibility and a liability release within 14 days of the date of notification. If the Winner fails to do so, the prize will be forfeited in its entirety and the participant who submitted the photograph receiving the next highest number of votes will be selected as the winner. The Winner must warrant that she or he is not prohibited by employment, contract, or law from entering the Contest or accepting a prize from the Sponsor.
The Winner will receive $500 (USD) (or foreign currency equivalent). If the Winner consents, The Winner will also have their winning photograph published in the Fall 2012 edition of Life in the Lab and throughout the Life Technologies’ social media pages. No substitutions are permitted, except by the Sponsor, which reserves the right to substitute the prize with one of equal or greater value. No refunds or credits are allowed. The prize is not transferable. All taxes on the prize and reporting thereof are the sole responsibility of the Winner.
By entering the Contest, each participant unconditionally accepts and agrees to comply with and abide by these rules and the decisions of the Sponsor, which shall be final and binding in all respects.
By submitting an entry to this Contest, entrant warrants that he/she has all of the rights and authority necessary to submit an entry to the Contest in compliance with these Terms and Conditions, including the right to publish the entry, and the right to grant a Publicity Release as requested by Sponsor. Entrants waive any and all rights to submissions and give Sponsor the right to publish same in any medium without compensating entrants.
Sponsor will publish the name of the Winner. The Winner consents to the use by Sponsor of Winner’s name and image in Sponsor’s press releases, announcements, or other marketing literature.
To the full extent allowed by law, participants and the Winner release, indemnify and hold harmless the Sponsor and its affiliates, directors, officers and employees from all liability for any damages, injury or losses to any person (including death and bodily injury) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in any promotion-related activity or participation in this promotion. The Sponsor has not made any warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. IN NO EVENT SHALL THE SPONSOR BE LIABLE, WHETHER IN CONTRACT, TORT, WARRANTY, OR UNDER ANY STATUTE OR ON ANY OTHER BASIS FOR SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, MULTIPLE OR CONSEQUENTIAL DAMAGES SUSTAINED BY ANY WINNER OR ANY OTHER PERSON OR ENTITY ARISING OUT OF THE SPONSOR'S PERFORMANCE OR FAILURE TO PERFORM ITS OBLIGATIONS RELATING TO THE AWARD OF THE PRIZE OR PERFORMANCE OF SERVICES, THE POSSESSION OR USE OF ANY PRODUCT, OR THE PERFORMANCE BY THE SPONSOR OF ANY SERVICES, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT THE SPONSOR IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM OR RELATED TO LOSS OF USE, LOSS OF DATA, DOWNTIME, OR FOR LOSS OF REVENUE, PROFITS, GOODWILL, OR BUSINESS OR OTHER FINANCIAL LOSS.
