Innovation Day Contest Complete Terms and Conditions

HOW TO ENTER: To enter the Innovation Day Contest (“Contest”) submit a completed Innovation Day Submission Form (“Submission Form”), a copy of which is available at thermofisher.com/innovationday.
ELIGIBILITY: Participation is open only to persons 18 years and older in the US (excluding Puerto Rico) who submit a completed Submission Form, including a nonconfidential description in the English language of an innovation idea and a statement explaining the problem solved or customer need addressed by the innovation idea in one of the following three categories:
- Research Tools: Innovative technologies, reagents, devices/apparatus, products, ideas that can solve an unmet customer need in the research tools market
- Consumer Devices: Application of consumer devices (e.g., iPhone, Android Phone) to research tools area
- Product Improvements: New combination, use or improvement to Thermo Fisher products.
There is a limit of five entries per participant and it is possible for a participant to win more than one prize. Four winners will be selected to receive a prize. First place will be awarded $10,000 cash. Second place will be awarded $3,000 product credit for Thermo Fisher Scientific products. Third place will be awarded $1,000 product credit for Thermo Fisher Scientific products. The People’s Choice winner will be awarded $1,000 Thermo Fisher Scientific product credit. If the participant is submitting the Submission Form on behalf of their employer, participant warrants that they have obtained any necessary permission to enter this Contest and authorization from their employer or responsible supervisor. Before a winner can receive their prize, they must submit written approval from the institution or company employing them stating that they can accept the prize from Sponsor.
Healthcare Professionals may not participate in this promotion. The term Healthcare Professionals includes clinical or non-clinical physicians (including MDs and MDs/Ph.D.s), and physician assistants, nurses, technicians, research coordinators, administrators and purchasing personnel and entities (including hospitals, rehabilitation centers, nursing facilities, home health agencies, clinics and group purchasing organizations, managed care organizations, physician group practices, medical directors for health insurance organizations) and their employees and representatives who are involved in the actual provision of health care services.
Void where prohibited, licensed, or restricted by federal, state, provincial, or local laws, regulations, or agency/institutional policy. Determination of eligibility is at Sponsor’s sole discretion. Affiliates, subsidiaries, distributors and other sales intermediaries, advertising, promotion, and fulfillment agencies of Sponsor, and immediate family members and employees, officers and directors of Sponsor or those living in their same household, are not eligible to participate.
DEADLINE FOR SUBMISSION: The Contest begins on August 8, 2016. Contest submissions must be received by Sponsor no later than September 16, 2016 at 11:59 p.m. US Pacific Time to be included in the Contest.
CONTEST CANCELLATION: Sponsor reserves the right to cancel the Contest if a minimum of 40 qualified submissions are not received by the Sponsor by the submission deadline. In the event that the Contest is cancelled, an announcement will be posted on thermofisher.com/innovationday and an email will be sent to each entrant to notify them of the cancellation.
JUDGES AND JUDGING CRITERIA: Submissions to the Contest will be judged by a panel of 4 qualified judges from Thermo Fisher Scientific with a mix of business, technical, marketing, and intellectual property backgrounds. Submissions will be judged on the following criteria:
- Degree of innovation: is the submitted idea original and innovative? For example, does the idea challenge existing paradigms; address an innovative hypothesis or critical barrier to progress in the field? Does the idea develop or employ novel concepts, approaches, methodologies, tools, or technologies? Is this a ‘game changing’ innovation? (25%)
- Value to customers: is there a pent up demand or does the idea solve an unmet need of customers? (25%)
- Technical and/or commercial feasibility: if the innovation is still in development or at concept stage, how likely is the innovation to be technically achievable? For example, is there a working prototype demonstrating proof-of-concept, or does the innovation rely on established and proven concepts or components that will likely work in a new combination? If the innovation is product ready, how likely is the product to be a commercial success? For example, is the path to market well defined, is the product customer friendly or easy to implement, is the product easy to manufacture, is the product able to be scaled-up to meet demand? (25%)
- Commercial opportunity: is there an estimated large commercial opportunity for the submitted idea, for example, is there a large addressable market? Are customers willing to pay for the innovation? Are there few competitors in the space? (25%)
Submission Forms must not contain any information that can be considered confidential, proprietary or a trade secret. Sponsor has no obligation to keep any information submitted as a part of this Contest confidential.
Submissions must relate to ideas that are for research purposes only, and not related to use in any diagnostic, therapeutic or clinical applications. Do not submit any data relating to patients, clinical studies, or medical treatment, or which contains any personally identifiable information, personal health information or other sensitive personal data.
SELECTION OF SEMI-FINALISTS: Up to 24 semi-finalists will be selected by the panel of 4 Thermo Fisher Scientific judges from all eligible submissions received. The semifinalists will be notified of their selection on approximately September 26, 2016. In order to remain eligible to win a prize, each semi-finalist, or their appointed proxy, who must also be 18 years or older, will be required to provide a live, in- person presentation of their submitted idea at Biocom, located at 10996 Torreyana Road, San Diego, California 92121 on October 12, 2016 (the “Event”). The semi- finalists will be responsible for their own accommodations and travel to the Event; no travel assistance or accommodations will be provided. Each semi-finalist will be asked to provide a copy of their proposed presentation to the Sponsor no later than October 10, 2016 at 11:59 p.m. US Pacific Time.
LIVE SEMI-FINALIST PRESENTATIONS: The semi-finalists will be divided into three or four smaller groups and each semi-finalist will be required to provide a live, in-person presentation to their panel of judges at the Event on the morning of October 12, 2016. Five minutes will be allotted for each presentation, with an additional five minutes allotted for questions from the judges. Each semi-finalist may bring their own computer and presentation handouts; no audio-visual support will be provided, e.g., no external power, projector screens or the like. Using the same judging criteria as set forth above, a full panel of judges consisting of 10 Thermo Fisher Scientific employees, one Biocom representative, and one Connect representative having backgrounds in business, finance, research & development, technical, marketing, and intellectual property backgrounds. will select up to six finalists from the pool of semi-finalists and the finalists will be notified of their selection at the Event between approximately 12:45 – 1:15 p.m.
LIVE FINALIST PRESENTATIONS: Each finalist will be required to provide a live, inperson presentation to the full panel of judges and the general public audience attending the Event on the afternoon of October 12, 2016. Each finalist will be allotted ten minutes for their presentation, which may consist of up to four PowerPoint slides if the slides were provided to Thermo Fisher Scientific by October 10, 2016. Finalists may provide other materials for their presentation, but no support or assistance will be provided other than a computer (PC) with the Microsoft™ PowerPoint™ program and screen. Five minutes per finalist presentation will be allotted for questions from the judges. The judges will use the same judging criteria as set forth above to determine three potential winners. The judges’ decisions are final on all matters. A People’s Choice winner will be determined by the audience text votes through a text poll. Each audience member is allowed one text vote.
WINNERS: The panel of judges will select three potential winners (each, a “Potential Winner”) from the pool of finalists. The placement of Potential Winners (first, second, or third) will be determined by the number of votes they received. The Potential Winners and the People’s Choice Winner will be notified of their prize at the Event at approximately 4:00 p.m. and must be present to win. A prize will be awarded to the Potential Winner contingent upon qualifying as a Winner. In order to qualify as a Winner, Sponsor must receive within 14 days after notification after notification of their being selected as a Potential Winner: (1) written approval from the institution or company employing a Potential Winner that the Potential Winner can accept the prize from Sponsor; (2) a signed Affidavit of Eligibility and Release of Liability/Prize Acceptance/Publicity Release form completed by the Potential Winner; and (3) an IRS form W-9 (Request for Taxpayer Identification Number). If they qualify, Potential Winners will be considered Winners. If a Potential Winner fails to qualify, he or she will not be eligible to receive a prize and the finalist with the next highest number of votes will be selected as a Potential Winner. The first place Winner will receive a check for USD $10,000. The second place Winner will receive $3,000 Thermo Fisher Scientific product credit in a spend-down account. The third place Winner will receive $1,000 Thermo Fisher Scientific product credit in a spend-down account. The People’s Choice Winner will receive $1,000 Thermo Fisher Scientific product credit in a spend-down account. If there is a tie in the voting for the People’s Choice award, then the $1000 Thermo Fisher product credit will be divided equally between the tying parties. Winners of Thermo Fisher Scientific product credit can only redeem their credit for Research Use products. Product credit must be redeemed within six (6) months of receipt of credit prize. If a Winner fails to accept their prize, the prize will be forfeited in its entirety and the finalist that garnered the next highest number of votes by the judges will be selected as a winner. The Winner must warrant that she or he is not a Healthcare Professional nor prohibited by employment, contract, or law from entering the Contest or accepting a prize from the Sponsor.
No refunds or credits are allowed. The prize is not transferable. All taxes on the prize and reporting thereof are the sole responsibility of the Winner. TAXES, INCLUDING FEDERAL, STATE, AND LOCAL TAX, IF ANY, RELATED TO THE PRIZE ARE THE RESPONSIBILITY OF THE WINNER AND SPONSOR WILL, IF APPLICABLE, ISSUE A 1099-MISC FORM TO THE WINNER.
By entering the Contest, each participant unconditionally accepts and agrees to comply with and abide by these rules and the decisions of the Sponsor, which shall be final and binding in all respects.
PUBLICITY: Sponsor will publish the name of the Winners. The Winner consents to the use by Sponsor of Winner’s name and image in Sponsor’s press releases, announcements, or other marketing literature.
INDEMNITY; DISCLAIMERS: To the full extent allowed by law, participants and each Winner release, indemnify and hold harmless the Sponsor and its affiliates, directors, officers and employees from all liability for any damages, injury or losses to any person (including death and bodily injury) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize or participation in any promotion-related activity or participation in this promotion. The Sponsor has not made any warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any prize, including, without limitation, to such prize’s quality or fitness for a particular purpose. IN NO EVENT SHALL THE SPONSOR BE LIABLE, WHETHER IN CONTRACT, TORT, WARRANTY, OR UNDER ANY STATUTE OR ON ANY OTHER BASIS FOR SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, MULTIPLE OR CONSEQUENTIAL DAMAGES SUSTAINED BY ANY WINNER OR ANY OTHER PERSON OR ENTITY ARISING OUT OF THE SPONSOR'S PERFORMANCE OR FAILURE TO PERFORM ITS OBLIGATIONS RELATING TO THE AWARD OF THE PRIZE OR PERFORMANCE OF SERVICES, THE POSSESSION OR USE OF ANY PRODUCT, OR THE PERFORMANCE BY THE SPONSOR OF ANY SERVICES, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT THE SPONSOR IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM OR RELATED TO LOSS OF USE, LOSS OF DATA, DOWNTIME, OR FOR LOSS OF REVENUE, PROFITS, GOODWILL, OR BUSINESS OR OTHER FINANCIAL LOSS.
