Please read the following Terms and Conditions carefully before participating in the promotion campaign for the Chromeleon CDS Educational Challenge (“Campaign”) conducted and sponsored by the Chromatography and Mass Spectrometry Division of Thermo Fisher Scientific Pte. Limited, (‘Thermo Fisher/Us/ We/Sponsor’) having its registered office located at Thermo Fisher Scientific Pte. Ltd, 33 Marsiling Industrial Estate Rd 3, #07-06, Singapore 739256. By participating in the Campaign, you agree to be bound by these Terms & Conditions and represent that you satisfy all of the eligibility requirements set out herein below.
These terms and conditions (‘Terms and Conditions’/ ‘T&Cs’) govern your participation in this Campaign. on https://www.thermofisher.com/sg/en/home/about-us/events/industrial/chromeleon-cds-educational-challenge.html (“Website/App/Platform”). You (‘Participant(s)’ / ‘You’ / ‘Your’) may voluntarily participate in the Campaign subject to Your unconditionally acceptance to comply with and abide by the Terms and Conditions and are eligible as per the rules for participation/offer terms and conditions listed herein below. You hereby agree and understand that the Privacy Policy, available at https://www.thermofisher.com/privacy-policy.html?cid=fl-privacypolicy shall apply to Your participation in this Campaign and for the usage of any of Your personal information that may be received by Thermo Fisher during or pursuant to your participation. By participating in this Campaign, it is deemed that the Participant(s) have read, understood, accepted and agreed to irrevocably, unconditionally abide by and be bound by all the terms and conditions and to the Privacy Policy. If You do not agree to be bound or cannot comply with any of the Terms and Conditions, please do not continue to participate in the Campaign. Your failure to accept or comply with the provisions of these Terms & Conditions will disqualify You from participation. The decision of Thermo Fisher for all matters relating to Your participation shall be final and binding in all respects.

GENERAL TERMS AND CONDITIONS

NO PURCHASE NECESSARY TO ENTER OR WIN.
In accordance with applicable laws, if the Participant is registered with Do Not Disturb (DND) service, the Participant will not receive email confirmation and hence will no longer be eligible to participate in the Contest. Please write to Us at CMD.APACMarketing@thermofisher.com for any queries in relation to the Campaign.
Winner (defined below) will be intimated via email. Winner will receive the gift via courier to the address provided by them.
Participation in this promotion is open only to science professionals 21 years and older in Australia, India (not applicable in the state of Tamil Nadu), Japan, New Zealand, Southeast Asia (Brunei, Cambodia, Indonesia, Laos, Malaysia, Myanmar, Philippines, Singapore, Thailand, Timor-Leste and Vietnam), Japan, South Korea and Taiwan. Employees of the Sponsor and its affiliates, as well as their immediate family members and household members, are not eligible. The Participant should not have a criminal conviction or an arrangement or a contract that prevents the Participant from participating.
The details and any other information given by you in connection with the Campaign is original, true and accurate and Thermo Fisher is not/ shall not be responsible for verifying any information submitted by you. The gift is personal to the Winner and is not encashable, non-transferrable, or sold for value under any circumstances and cannot be clubbed with any other ongoing or future Contest/Offer/ promotions organized by Thermo Fisher.
Healthcare Professionals may not participate in this promotion. The term Healthcare Professionals includes individuals (clinical or non-clinical physician, including MDs and MDs/Ph.D.s), physician assistants, nurses, technicians, research coordinators, administrators and purchasing personnel) and entities (including hospitals, rehabilitation centres, nursing facilities, home health agencies, clinics and group purchasing organizations, managed care organizations, physician group practices, medical directors for health insurance organizations) and their employees and representatives who are involved in the actual provision of health care services. Determination of eligibility is at Sponsor’s sole discretion.
Government Officials may not participate in this promotion. The term Government Official includes anyone who acts in an official capacity for or on behalf of a government entity, department, or agency. Void where prohibited, licensed, or restricted by federal, state, provincial, or local laws, regulations, or agency/institutional policy. Determination of eligibility is at Sponsor’s sole discretion.
Participant agrees to comply with all federal, state, and local laws, rules and regulations pertaining to its performance under this Agreement. Moreover, Participant acknowledges and agrees that any payments made to him will not be used for any payment in violation of any applicable law, rule, regulation practice or code of ethics. Participant agrees and confirms that it will comply with the anti-bribery provisions of the US Foreign Corrupt Practices Act. In particular, neither Participant nor any person employed by it or its business or representing the business has or will make any offer, promise or authorize directly or indirectly any payment or transfer of anything of value to any official, representative or employee of any government, government agency or instrumentality, for the purpose of influencing a decision by any of them to take actions favourable to the Company or represent them on any matter related directly or indirectly to sourcing the services.
The Sponsor reserves the right to substitute the gift. No refunds or credits are allowed. Gift is not transferable. All taxes on the gift and reporting thereof are the sole responsibility of the Winner. Gifts will be voided where prohibited by law or company policy. Products purchased as part of the Offer will not be taken back or exchanged.
The Sponsor reserves the right to terminate/vary/withdraw/substitute the gift at any time, without prior notice and without having to disclose any reason therefore and without any payment or compensation.
Sponsor reserves the right to change the terms and conditions of this Offer, including extending, withdrawing, or discontinuing the same without notice, without assigning any reason, at their sole discretion and without any liability.
Sponsor is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to Participant’s or any other person's mobile handset, or computer related to, or resulting from, participation in this Offer or the downloading of any materials related to this Offer.
If for any reason this Campaign is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorized intervention, technical failures or any other causes beyond the reasonable control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Offer, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Offer, subject to any written directions made under applicable Laws.
To the full extent allowed by law, participants and the Winners release, indemnify and hold harmless the Sponsor and its affiliates, directors, officers and employees from all liability for any damages, injury or losses to any person (including death and bodily injury) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the gift or participation in any promotion-related activity or participation in this promotion. The Sponsor has not made any warranty, representation, or guarantee, express or implied, in fact or in law, with respect to any gift, including, without limitation, to such gift’s quality or fitness for a particular purpose. IN NO EVENT SHALL THE SPONSOR BE LIABLE, WHETHER IN CONTRACT, TORT, WARRANTY, OR UNDER ANY STATUTE OR ON ANY OTHER BASIS FOR SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE, MULTIPLE OR CONSEQUENTIAL DAMAGES SUSTAINED BY ANY WINNER OR ANY OTHER PERSON OR ENTITY ARISING OUT OF THE SPONSOR'S PERFORMANCE OR FAILURE TO PERFORM ITS OBLIGATIONS RELATING TO THE AWARD OF THE GIFT OR PERFORMANCE OF SERVICES, THE POSSESSION OR USE OF ANY PRODUCT, OR THE PERFORMANCE BY THE SPONSOR OF ANY SERVICES, WHETHER OR NOT FORESEEABLE AND WHETHER OR NOT THE SPONSOR IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES ARISING FROM OR RELATED TO LOSS OF USE, LOSS OF DATA, DOWNTIME, OR FOR LOSS OF REVENUE, PROFITS, GOODWILL, OR BUSINESS OR OTHER FINANCIAL LOSS.
You agree and understand that the decision of Thermo Fisher will be final, and binding and You hereby waive any legal right that You may have to protest and/or dispute the decision of Thermo Fisher
Caution: any attempt to deliberately damage Sponsor’ App or promotional website or the information on the website, to cause malicious damage or interference with the normal functioning of the website, or to otherwise undermine the legitimate operation of this Offer may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, Thermo Fisher reserves the right to seek damages to the fullest extent permitted by law. If Thermo Fisher suffers loss or incurs any costs in connection with any breach of these terms or any other legal obligation by a Participant, the Participant agrees to indemnify Thermo Fisher for those losses, damages, and costs.
Thermo Fisher will have no legal and financial liability on unclaimed offers, incentives, vouchers, etc. beyond the applicable period of the Offer.
You hereby acknowledge that there does not now exist, nor has there ever existed, a fiduciary relationship, or a relationship in the nature of an agent and principal between you and Thermo Fisher. You further acknowledge that mere participation in the Campaign shall not result in the establishment of a fiduciary relationship, or a relationship in the nature of an agent and principal between You and Thermo Fisher
You hereby acknowledge that in case any portion/clause of these Terms and Conditions is deemed invalid or becomes unenforceable or prohibited by the law of the country, such portions shall be considered divisible and shall not be part of the consideration, and the remainder of these Terms and Conditions shall be valid and binding and of like effect as though such provision was not included herein.
For Indian customer to claim the gift, the winners shall have to send their valid ID proof as per communication received from the Company. If gift is not claimed within thirty (30) days of declaring winner the same shall lapse automatically without any further notice.
All entries and their content become the property of the Sponsor and will not be returned. By registering for the event/session, you are agreeing to receive further information from the Sponsor in accordance with the Sponsor’s privacy policy, which can be found at thermofisher.com/privacypolicy.
In the event of any dispute, the decision of the Sponsor is final.
In addition to the General Terms and Conditions, other Terms and Conditions stated in the respective sections below apply.
The Participant provides his/her irrevocable consent to Sponsor to use written comments, and the like for the purpose of creating advertising and promotional materials to be used in all forms of media including without limitation, analog, digital or interactive media including internet, CD/CD Rom/DVD, posters, banners, print media such as magazines, newspapers, danglers, hoardings, leaflets, etc., without any compensation whatsoever.
The Participant authorizes, permits, and grants consent to Sponsor, its affiliates, group companies and/or their authorized representatives to utilize the content for the purposes of the Campaign and the gift and further Exploit (as defined hereinafter) such content in any other manner as Sponsor may deem fit. The Participant does hereby release in favour of and assign to Sponsor all rights including but not limited to the intellectual property rights in and to the content/story, on any and all medium, mode and platforms, now or hereafter known, for world and in perpetuity.
You hereby understand that Sponsor makes no representation and/or warranties regarding the Campaign or any matter in connection therewith other than those expressly given in these T & C and hereby expressly disclaims all other warranties, expressed or implied.
Thermo Fisher does not assume any responsibility with respect to the merchantability and quality of the gift awarded.
Any dispute regarding defective, deficient, or unsatisfactory quality of the gift must be addressed by the winner(s) directly with the manufacturer and/or the Authorized Dealer or as mentioned and specified on the packaging.

Entry to the Offer is void in territories where prohibited/not allowed.
You hereby acknowledge that your representations, warranties, indemnities and obligations as well as the confidentiality provisions and dispute resolution mechanism shall survive the efflux of time and the termination of these Terms and Conditions.
You shall not undertake any act, either directly or indirectly or publish any comments, statements on any social media or otherwise through any modes and/or mediums or otherwise which may bring Thermo Fisher into public disrepute.
You acknowledge that in case the Campaign and/or any of Thermo Fisher obligation cannot be fulfilled due to war, industrial action, flood or any act of God or event beyond the reasonable control of Thermo Fisher then such non-performance or failure shall not be deemed as a breach of these Terms and Conditions and if such inability to perform such obligation continues for a period of seven (7) days, then Thermo Fisher shall be at liberty upon their sole discretion to terminate the Campaign and/or the participation of an Participant forthwith and such decision shall be final and binding.
You hereby acknowledge that your voluntary participation in the Campaign is voluntary and out of Your free will and consent, without any monetary compensation whatsoever.
You hereby acknowledge that you have fully read and understood these Terms and Conditions voluntarily, without coercion or any undue influence of any kind whatsoever on the part of Thermo Fisher and with complete understanding of all of the terms and conditions contained herein and shall agree to the contents of these Terms and Conditions.

GIFT ELIGIBILITY/Participation Process

The Offer is available to the top 20 Participants who successfully enter and played the game to receive one set of Charlie Doll and a Notebook (“Giveaway”) by participating in the challenge. From 8 July 2024 until 13 September 2024 on https://www.thermofisher.com/sg/en/home/about-us/events/industrial/chromeleon-cds-educational-challenge.html. Participants may be required to submit their personal information such as name, contact information and email address. Entries with profanity, threatening language, or demeaning content will be excluded. Winners will be notified by email or telephone after the end of the submission period.

The Sponsor reserves the right to substitute the gift. No refunds or credits are allowed.

Gift is not transferable. All taxes on the gift and reporting thereof are the sole responsibility of the Winner. Gifts will be voided where prohibited by law or company policy.

I hereby consent to the collection, receipt, storage, use, transfer, and retention of my personal information as defined under the Information Technology Act, 2000 and the rules and regulations promulgated thereunder including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 (“Personal Information”), which Personal Information is subject to: (i) the Privacy Policy, and (ii) the following terms and conditions:

a. I have read, understood and accepted the Terms and Conditions and Privacy Policy and I understand and agree that my Personal Information is subject to the terms of these Terms & Conditions and the Privacy Policy.

b. My Personal Information may be collected by Thermo Fisher pursuant to these Terms and Conditions, in connection with the Campaign and it may be necessary for Thermo Fisher to collect the Personal Information for the Campaign and the uses set out below.

c. My Personal Information may be shared by Thermo Fisher with any designated third party(ies), as deemed fit, in connection with the Campaign.

d. All my Personal Information is true, correct, and complete in all respects and in no event will Thermo Fisher and/or its affiliates be liable for either of the authenticity of the Personal Information or any inaccuracies or deficiencies in my Personal Information. Thermo Fisher has provided me with the option to opt out of providing my Personal Information, and I have not exercised such option.
